Welcome to the Tout Près Art website. The following Terms of Use (“Terms”) govern your interaction with the website at http://www.toutpresart.com and any social media sites controlled by Tout Près Art and its subsidiaries or affiliated entities (collectively, the “Web Site”).
We invite you to read this page carefully. By accessing or using the Web Site, you acknowledge and agree to be bound by these Terms. When you choose to purchase our products you are subject to the following terms and conditions, as once products have been bought, you are agreeing to abide by these conditions.
If these Terms do not resonate with you, we kindly ask that you refrain from using the Web Site.
2. DATA PROTECTION AND SECURITY
Any personal information that you provide us including your name, address, telephone number and email address will never be shared, sold, or rented to any entities beyond Tout Près Art.
We will retain your contact details solely to fulfill your orders and, when necessary, to communicate with you regarding your purchases. With your permission we may also send you updates about exclusive offers and promotions curated and sanctioned by Tout Près Art.
All credit card payments are processed securely through the Stripe Payment Gateway. Rest assured, Tout Près Art does not collect or store any credit card details provided during your purchase, ensuring your financial details remain private.
3. USER CONDUCT
By accessing and using the Web Site, you agree:
(i) Abide by all relevant laws and regulations, both national and international, that govern your use of the Web Site;
(ii) Refrain from disrupting or compromising the security and accessibility of the Web Site or any services associated with it;
(iii) Not transmit any content that is obscene, offensive, or harmful, including viruses or unsolicited mass emails, either directly or indirectly through the Web Site;
(iv) Provide truthful and accurate information regarding your identity should you choose to register on the Web Site; and

All content published on the Web Site (the “Contents”) is protected by intellectual property laws and is either owned or licensed by Tout Près Art. We grant you a limited right to access and use the Web Site for your personal enjoyment. You are also prohibited from using any automated tools or manual processes to copy, monitor, index, or mine the Web Site’s data.
Tout Près Art name, logos, trade dress, and the distinctive layout of the Web Site are protected as registered and/or unregistered service marks, trademarks, and/or trade dress of Tout Près Art, and may not be used, copied, imitated, in whole or in part, without our express written permission. All other copyrighted images, trademarks, product names, company names, and logos mentioned on the Web Site remain the property of their respective owners.
5. PRICING
All pricing is in Australian Dollars (AUD). Tout Près Art reserves the right to alter prices at our discretion and without prior notice.
6. PLACING AN ORDER
When you place an order through the Web Site, you’ll receive an email confirming we’ve received it, along with your details of your purchase. This is simply an acknowledgement, not yet an acceptance, and does not guarantee fulfillment. Should any issues arise, a member of our team will be in touch to help find a resolution. All items are subject to availability, and a binding agreement is only formed once your order has been dispatched – you’ll receive a second email confirming it’s on its way. Until then, we reserve the right to decline or withdraw from any order, particularly in cases of errors or inaccuracies on the Web Site or within the order.
7. ACCURACY OF INFORMATION
We do our very best to ensure that all information on our Web Site, including pricing is accurate. Still, from time to time, small errors or discrepancies may arise. If we happen to discover an issue with the price of an item you’ve ordered, we’ll reach out to you as soon as we can. You’ll have the choice to proceed with the corrected price or to cancel your order entirely. If we’re unable to reach you after reasonable efforts, we’ll treat the order as cancelled and will ensure you receive a full refund with our sincerest apologies.
8. DELIVERY
Your order will be sent to the delivery address you provided at checkout, as confirmed in your order confirmation email. As your order is carefully prepared, dispatch will only take place once payment has been received and cleared.
Estimate delivery times can be found in our Shipping & Returns page. While we always do our utmost to meet these timelines, delays can sometimes arise due to circumstances beyond our control. We appreciate your patience and understanding, and kindly note that we cannot accept responsibility for delays outside of our hands.
To protect your investment, all packages require a signature on delivery. Should you choose to waive this with an “authority to leave” please understand that Tout Près Art cannot be held responsible for any loss, damage, or theft thereafter.
The moment your order arrives at your door, the responsibility for its care passes to you. For fine art print orders, your fine art print is delicate and should only be removed from the packaging by a professional framer.
9. RETURNS & CANCELLATIONS
All our fine art prints are made-to-order, thoughtfully crafted just for you. As every fine art print is custom made, we’re unable to accept returns for change-of-mind purchases. We kindly encourage you to choose carefully before placing your order. Please note that all sales are final, and we thank you for your understanding.
Each fine art print begins its journey the moment the order is placed and is sold on a made-to-order basis. As such, orders may not be cancelled once production has begun or 24 hours have passed since placing your order. If you’re unsure or need to check on the status of your order, we warmly invite you to reach out, we’re here to help.
10. PROMOTIONAL CODES
Promotional codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotional code, to purchase gift certificates, and must be redeemed by the date published, if provided.
11. GIFT CERTIFICATES
Our gift certificates are available in any amount, starting at $50, offering a flexible and thoughtful way to give. They’re valid for 36 months from the date of purchase, so the recipient has plenty of time to find something they’ll love. Please note, these gift certificates can’t be redeemed for cash, so we encourage choosing something special. If the gift certificate is lost or stolen, we can’t replace it, so it’s best to treat it as you would cash. It’s also important to remember that the gift certificate is intended for the person it’s issued to. To redeem, simply enter the code at checkout. While taxes are unlikely, any that do apply will be calculated at checkout.
